The Workers’ Compensation/Claims Director plans, organizes, administers, and has oversight for the handling of all claims covered, or potentially covered, by the company’s various insurance programs such as workers’ compensation, general liability, automobile, umbrella, premises liability and pollution policies. You'll advise on workers’ compensation/claims issues and ensure compliance with applicable laws and regulations while maintaining a high level of customer service.
 
What You’ll Do:
  • Lead and/or participate in internal discussions regarding claims/workers’ compensation matters; represent the company externally to public and private agencies and appeal boards
  • Identify, evaluate, and assess probability and severity of losses; develop, implement, and monitor cost containment strategies to prevent and minimize losses
  • Oversee and ensure an efficient records maintenance system for claims and related information, data, and activities
  • Supervise the management of employee injury cases; investigate or oversee the investigation of claims; develop strategies to handle specific cases in consultation with the appropriate parties
  • Participate in budget preparations and monitor expenditures; determine the extent of the company’s liability; recommend and negotiate claim settlements
  • Recommend/establish reserves for anticipated claims costs; work closely with CLO and CFO to ensure reserves are appropriately and timely communicated
  • Collaborate with physicians, attorneys, employees, and management; develop and coordinate return-to- work plans; coordinate and monitor rehabilitation plans for injured employees; evaluate results of pre- employment and return-to-work medical examinations and make appropriate determinations
  • Attend claims related hearings, mediations, arbitrations, and trials; manage third-party subrogation cases to seek reimbursement from third parties
  • Respond to and resolve difficult and sensitive inquiries and complaints; evaluate problems and take appropriate action to resolve issues/concerns; notify injured employees of their benefits
  • Stay up to date and train others on claims trends and innovations and keep current on all relevant legislative and regulatory issues at the State and Federal level
  • Complete reports and maintain records; authorize payment on medical bills, permanent and temporary disability compensation
  • Partner with Operations and Safety to identify any negative safety trends leading to injuries; create and deliver training where appropriate
  • Monitor assigned staff including the selection, training, and evaluation of personnel; provide and coordinate staff training; work with employees to correct deficiencies; implement disciplinary action and termination procedures

What We Need from You:
 
Knowledge of:
  • Pertinent federal, state, and local laws, codes, and safety regulations including the State Labor Code, Workers’ Compensation and Americans with Disabilities Act laws, OSHA, and employment laws, procedures, and regulations
  • General liability, automobile, umbrella, premises liability and pollution policies
  • Claims reserve setting principles/best practices
  • Successful identification and implementation of claims management system
  • Research, statistical, and financial analysis
  • Medical and technical terminology used in industrial injury cases
  • Administrative principles and methods, including goal setting, program and budget development, work planning, and organization
  • Principles and processes of record keeping and report preparation
Skills:
  • Aligns course of action to maximize organizational goals through effective planning and efficient performance of the department
  • Build, organize, and manage a worker’s compensation and claims program for a large employer
  • Ability to appropriately choose and implement claims management system
  • Use data to identify trends and make recommendations instrumental in decreasing the overall cost of claims to the company
  • Effectively partner with Legal, Finance, Safety and Operations executives to improve claims handling and decrease claims related risk for the company
  • Appropriately notify and update carriers of incoming claims/claims status
  • Analyze complex problems, evaluate alternatives make creative recommendations
  • Maintain accurate and complete records
  • Establish and maintain effective working relationships
  • Proficiency in PowerPoint and Excel
  • Excellent verbal and written communication skills with ability to simply and succinctly present information and recommendations to cross functional members of executive team
Education/Experience:
  • Equivalent to a bachelor’s degree from an accredited college or university with major course work in public administration, business administration, risk management, workers’ compensation, or closely related field (any combination of education and experience that would provide the required knowledge and abilities is qualifying)
  • Prior oversight experience for the handling of all claims covered, or potentially covered, by various
  • insurance programs such as worker’s compensation, general liability, automobile, umbrella, premises
  • liability and pollution policies
  • Ten years of progressively responsible professional and administrative experience in a self-insured or self- administered workers’ compensation program, including supervisory experience preferably in a construction environment
Work Environment:
  • Standard office setting with some travel between sites
  • Ability to work remotely as needed/required
  • Travel by automobile and airplane will occasionally be required
Certificates, Licenses, Registrations:
  • CPCU or ARM professional designation is preferred
Physical Demands
  • Regularly required to sit, talk, and hear. Occasionally required to stand and walk. Occasionally required to climb short ladders and/or scaffolding, occasionally required to climb into and out of the cargo area of a truck, and occasionally required to climb into confined spaces.
