Duties and Responsibilities- Responsible for developing a Litigation Plan in conjunction and consultation with the assigned Litigation Examiner; modify as needed throughout process.
- Prepare pleadings, argue motions, represent the Company in litigation hearings; responsible for all aspects of the litigation process.
- Responsible for ensuring compliance with all Orders entered in each assigned case and complying with all Administrative Orders.
- Responsible for ensuring complete compliance with the Florida Rules of Civil Procedure and the Florida Evidence Code.
Education, Experience and Licensure Requirements- Degree from ABA-approved program
- Licensed by the Florida Bar and a member in good standing
- Minimum 3 years of experience practicing in Florida
- Minimum 1 year of experience specializing in first-party property defense
Qualifications/Skills & Competencies- A thorough understanding of the Florida Rules of Civil Procedure, Florida Evidence Code, Florida Rules of Judicial Administration, as well as specifically Chapter 624 and Chapter 627 of the Florida Insurance Code.
- A thorough understanding of the Florida Administrative Code specifically;
- Chapter 690 – Insurance Regulation,
- Chapter 69B-153 Deceptive Insurance Practices,
- Chapter 69B-166 Property and Casualty Insurer Practices, Chapter 69B-220 Adjusters.
- For sinkhole losses, Chapter 69B-251 Neutral Evaluators.
- A thorough understanding of the Rules Regulating the Florida Bar, specifically the Rules of Professional Conduct.
- Extensive knowledge of case law governing Florida insurance claims.
- Highly organized with the ability to handle and maintain daily tasks associated with the case load.
- Strong communication skills; ability to clearly and succinctly articulate position.
- Articulate presentation skills using technology.
- Strong and persuasive legal writing skills and oral advocacy skills.
- Independent ability to analyze legal issues with minimal supervision.
